Please read these Terms and Conditions carefully before using the Website. By using the Website, creating an account, purchasing a product or service, subscribing to a recurring service, or clicking to accept these Terms where that option is provided, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Website.

The Website and its services are intended for persons who are 18 years of age or older. By using the Website, you represent that you are at least 18 and legally capable of entering into a binding agreement. If you are under 18, you may use the Website only with the involvement and consent of a parent or legal guardian where permitted.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will provide notice through the Website or by another reasonable method where appropriate. The revised Terms will state their effective date. Your continued use of the Website after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

Privacy

Your use of the Website is also subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy for information about how we collect, use, disclose, and protect personal information.

Disclaimer

Your use of the Website and our educational materials is also subject to our Disclaimer, if separately provided. Information made available through the Website is for educational and informational purposes only and is not legal, financial, tax, medical, veterinary, mental-health, or other professional advice.

Accessing the Website and Account Security

We may modify, suspend, or discontinue any portion of the Website or any service or material offered through it. We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free.

If you create an account, you agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for activity occurring under your account and must promptly notify us of unauthorized access or a security breach.

We may suspend or terminate an account when reasonably necessary, including where we believe the account has been used in violation of these Terms or applicable law.

No Unlawful or Prohibited Use and Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Website and materials made available through it solely for their intended purposes and in accordance with these Terms.

You may not use the Website or its materials for an unlawful purpose; interfere with the Website; attempt to gain unauthorized access; introduce malicious code; scrape or systematically copy content; or obtain materials by means not intentionally made available by us.

Unless otherwise stated, all text, artwork, illustrations, photographs, graphics, logos, designs, downloads, courses, programs, videos, audio, written materials, compilations, and other content provided by Green Monarch Equine are owned by or licensed to Green Monarch Equine and are protected by applicable intellectual-property laws.

You may not reproduce, republish, distribute, sell, sublicense, publicly display, publicly perform, modify, create derivative works from, reverse engineer, or commercially exploit our content without our prior written permission, except for uses expressly permitted by these Terms or applicable law.

The Green Monarch Equine name, logo, and related branding are trademarks or trade names of the Company or its licensors where applicable. You may not use them without prior written permission.

Educational and Informational Purposes Only

Information provided through the Website and downloadable resources is provided for general educational and informational purposes. It is not intended to replace advice from a qualified professional.

In particular, information concerning horses, horsemanship, animal behavior, training, wellness, or related subjects should not be treated as veterinary, medical, legal, or other professional advice. You are responsible for obtaining appropriate professional advice for your individual circumstances.

Accuracy and Personal Responsibility

We make reasonable efforts to provide useful and accurate information, but we do not warrant that all information is complete, current, or error-free.

You are responsible for your own decisions and actions based on information obtained through the Website. You agree to exercise appropriate judgment and seek qualified professional advice where appropriate.

No Guarantees as to Results

We do not guarantee any particular personal, professional, financial, business, equestrian, training, educational, or other outcome from using our Website, products, courses, programs, or services.

Testimonials, examples, case studies, or descriptions of prior results are illustrative only and do not guarantee that you will achieve the same or similar results.

Email and Other Electronic Communications

By using the Website, submitting information through the Website, or communicating with us electronically, you consent to receive electronic communications relating to your transactions, account, services, and other matters for which electronic communication is legally permitted.

Electronic records and electronic signatures may be used to form agreements and provide notices. Nothing in these Terms is intended to eliminate any right or requirement that cannot lawfully be waived.

You acknowledge that ordinary email may not be a secure method of communication and agree not to send highly sensitive information by ordinary email.

User Communications and Community Services

The Website may include comment areas, forums, communities, messaging features, or other communication services. You agree to use those services lawfully and respectfully.

You may not use communication services to harass, threaten, defame, impersonate, unlawfully discriminate against, or invade the privacy of another person; post unlawful, infringing, obscene, or malicious material; distribute malware; collect another person's information without authorization; or violate applicable law.

We may moderate or remove content that violates these Terms or applicable law and may restrict access to communication features when reasonably necessary.

We are not responsible for statements, opinions, or content posted by other users.

Materials You Provide to the Website

You retain ownership of original materials you submit to the Website unless you separately agree otherwise.

By submitting content to a public or interactive area of the Website, you grant Green Monarch Equine a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content as reasonably necessary to operate, maintain, and promote the applicable Website feature.

You represent that you own or have the necessary rights and permissions to submit the material and that your submission does not violate another person's rights or applicable law.

If you provide private feedback or communications, we will use them in accordance with our Privacy Policy and the purpose for which they were provided.

Links to Third-Party Websites and Services

The Website may contain links to third-party websites or services. Those websites are not controlled by Green Monarch Equine, and we are not responsible for their content, availability, privacy practices, or terms.

A link does not necessarily constitute an endorsement.

Third-party providers may process information when they provide payment processing, website hosting, email, scheduling, analytics, course delivery, or other services. Such processing is subject to applicable agreements and privacy practices.

Templates, Forms, Downloads, Courses, and Programs

Where we provide templates, forms, downloadable materials, courses, programs, or similar resources, we grant you a limited, personal, non-exclusive, non-transferable license to use the materials for your own personal or internal business purposes unless the applicable product description states otherwise.

You may not resell, redistribute, sublicense, share account access, or otherwise commercially exploit those materials without our prior written permission.

You may complete and modify a template or form for your authorized personal or internal business use, but you may not redistribute the underlying template or form as your own product.

Subscriptions and Automatic Renewals

Certain products or services may be offered on a recurring monthly or yearly basis.

Before you subscribe, we will clearly disclose the recurring nature of the subscription, the applicable price, the renewal terms, and how you can cancel.

For Idaho consumers, Green Monarch Equine will provide cancellation methods consistent with Idaho Code § 48-603G, including a cost-effective, timely, easy-to-use online cancellation mechanism without an additional cancellation fee. Where required by Idaho law, cancellation will also be available through the same manner used to subscribe.

For subscriptions that constitute an "extended automatic subscription renewal" under Idaho law (generally, an automatic renewal for a term of 12 months or more), we will provide the required renewal notice between 30 and 60 days before the renewal date, including the information and cancellation methods required by law.

Unless otherwise stated at checkout, cancellation stops future renewals but does not automatically entitle you to a refund for the current subscription period, except where a refund is required by applicable law or expressly provided by the applicable offer.

Cancellation of Services

If you purchase a service that is not an automatically renewing subscription, any cancellation terms, deadlines, deposits, or scheduling requirements will be stated in the applicable service agreement, checkout page, or booking terms.

If no separate cancellation terms apply, you may contact us to request cancellation. Any refund or credit will be handled according to the applicable purchase terms and applicable law.

Refunds

Unless a particular product, service, or offer states otherwise, sales are generally final. We do not promise refunds or money-back guarantees except where expressly stated or required by applicable law.

Nothing in this section is intended to waive, restrict, or exclude any consumer right or remedy that cannot lawfully be waived or excluded under Idaho law or other applicable law.

No Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." GREEN MONARCH EQUINE DISCLAIMS WARRANTIES THAT MAY LAWFULLY BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE WEBSITE OR ANY CONTENT WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, UNINTERRUPTED, OR ERROR-FREE.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS A WARRANTY, REPRESENTATION, OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GREEN MONARCH EQUINE AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE WEBSITE, PRODUCTS, SERVICES, OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASE OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO GREEN MONARCH EQUINE FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT APPLICABLE LAW DOES NOT PERMIT US TO LIMIT.

Equine Activities and Assumption of Risk

Some Green Monarch Equine services, events, programs, or activities may involve horses or other equine-related activities.

Equine activities involve inherent risks, including the possibility of unpredictable animal behavior, falls, collisions, bites, kicks, and other injuries or property damage.

If an activity qualifies as an equine activity under the Idaho Equine Activities Immunity Act, Idaho law may provide protections to an equine activity sponsor or professional for certain inherent risks. Those statutory protections apply only to the extent their legal requirements are satisfied and do not replace any separate participant agreement, release, warning, or safety requirements applicable to a particular activity.

Where a particular activity involves riding, handling, training, or direct participation with an equine, participants may be required to sign a separate activity-specific release, acknowledgment, or assumption-of-risk agreement before participating.

Dispute Resolution and Arbitration

We encourage you to contact Green Monarch Equine first so that we can attempt to resolve any dispute informally.

To the extent permitted by applicable law, any dispute arising out of or relating to these Terms, the Website, or a product or service will be resolved by binding arbitration in the State of Idaho, unless the parties agree otherwise.

The arbitration will be administered by a mutually agreed-upon arbitration provider under its applicable consumer or commercial rules, as appropriate. The arbitrator will have authority to award any individual remedy that would be available in a court of law, subject to applicable law and these Terms.

Nothing in this section prevents either party from bringing an eligible claim in small claims court, seeking temporary or preliminary injunctive relief where permitted by law, or exercising a right that cannot lawfully be waived.

Any arbitration provision will be interpreted and enforced only to the extent permitted by applicable federal and Idaho law.

Governing Law and Venue

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except to the extent federal law or another applicable mandatory law requires otherwise.

For matters that are not subject to arbitration, the parties agree that courts located in Idaho will have jurisdiction to the extent permitted by law.

International Users

The Website is operated from the United States. If you access the Website from outside the United States, you are responsible for complying with laws applicable to you.

Nothing in these Terms is intended to deprive a consumer of mandatory rights or protections that apply in the consumer's jurisdiction and cannot legally be waived.

Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Green Monarch Equine and its owners, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, costs, and reasonable attorneys' fees arising from your unlawful use of the Website, your violation of these Terms, your infringement of another person's rights, or your submitted content.

This provision does not require you to indemnify Green Monarch Equine for the Company's own conduct to the extent such an obligation would be prohibited by applicable law.

Termination and Access Restriction

We may suspend or terminate your access to the Website or a service when reasonably necessary, including for violation of these Terms, unlawful conduct, fraud, abuse, or security concerns.

Termination does not affect rights or obligations that by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability, dispute-resolution provisions, and payment obligations already incurred.

No Joint Venture or Other Relationship

Your use of the Website or purchase of a product or service does not create a partnership, joint venture, employment, franchise, or agency relationship between you and Green Monarch Equine.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be modified or limited to the minimum extent necessary to make it enforceable, where legally permitted. If it cannot be made enforceable, it will be severed, and the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, and any product-, service-, or purchase-specific terms expressly incorporated by reference, constitute the agreement between you and Green Monarch Equine concerning your use of the Website and supersede prior communications concerning the same subject matter.

Changes to Terms

The most current version of these Terms will be posted on the Website and will identify its effective date. We encourage you to review the Terms periodically.
